Terms of Service

These terms and conditions ("Terms") govern your use of Kidtellect (the "Service"), operated by us ("Kidtellect", "we", "us" or "our"). By creating an account, browsing the site, or taking a quiz, you agree to these Terms. If you do not agree, please do not use the Service.

This is a general-purpose template provided for convenience and does not constitute legal advice. Please have it reviewed by a solicitor before relying on it.

1. Who can use Kidtellect

Kidtellect is designed for children and families. If you are under 13, a parent or guardian must create and manage your account on your behalf as part of a family account. By creating a family account, a parent or guardian confirms they are the parent or legal guardian of any child added as a learner profile, and they consent to this policy and these Terms on that child's behalf.

2. Accounts and learner profiles

You can take most quizzes as a guest without an account, but your results won't be saved. Creating an account lets you (or, for a family account, your parent/guardian) track progress, earn XP, and manage one or more learner profiles.

  • You are responsible for keeping your account credentials (and any learner PIN) confidential.
  • You must provide accurate information when registering.
  • Parents/guardians are responsible for activity carried out under learner profiles they manage.
  • We may suspend or close accounts that we reasonably believe are being misused.

3. Acceptable use

When using Kidtellect you agree not to:

  • Use the Service for any unlawful purpose or in a way that could harm, disable or overburden it;
  • Attempt to gain unauthorised access to another user's account or to any part of the Service;
  • Upload or submit content (including via the contact form) that is abusive, obscene, or infringes someone else's rights;
  • Use automated means (bots, scrapers) to access the Service without our permission.

4. Quizzes, content and educational use

Quiz content, questions and answers are provided for educational and entertainment purposes. We take reasonable care to keep content accurate and age-appropriate, but we do not guarantee that it is complete, error-free, or suitable for any particular curriculum or exam board. XP, levels, streaks and achievements are for motivation only and have no monetary value.

5. Intellectual property

The Kidtellect name, logo, site design, and quiz content are owned by us or our licensors and are protected by copyright and other intellectual property laws. You may use the Service for your own personal, non-commercial learning, but you may not copy, redistribute, or exploit the content commercially without our prior written consent.

6. Third-party services

The Service may use third-party services (such as Google reCAPTCHA to protect our forms from spam) that are subject to their own terms and privacy policies. We are not responsible for the content or practices of third-party services we link to.

7. Disclaimer and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from your use of, or inability to use, the Service. Nothing in these Terms limits any liability that cannot legally be limited, including liability for death or personal injury caused by negligence, or fraud.

8. Termination

You may stop using the Service and close your account at any time by contacting us. We may suspend or terminate access to the Service, in whole or in part, if we reasonably believe these Terms have been breached, or to protect the safety of our users.

9. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Continuing to use the Service after changes take effect means you accept the revised Terms.

10. Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
